The Services we offer allow you to search through the website and purchase products from our brand. As part of the Services, we also provide some ancillary services such as arranging delivery of the products, providing you with customer service assistance and payment processing without charge. We offer you the customer service you would need if you had any problem with the delivery. Your contract with us is concluded once the products have been delivered to you by the courier or have been collected by you from a Partner.

We have used headings to help you understand these Terms and Conditions and to easily locate information. We will not file copies of the contracts between us and you relating to our supply of the Services, so we recommend that you print or save a copy of these Terms and Conditions for your records (but please note that we may amend these Terms and Conditions from time to time so please check the Website regularly, and each time you use the Services to order products, to ensure you understand the legal terms which apply at that time).

Our liability to you in relation to the Services

If, in providing the Services to you, we fail to comply with these Terms and Conditions, we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms and Conditions or our negligence, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it was an obvious consequence of our breach or if it was contemplated by you and us at the time you started using the Services.

We do not in any way exclude or limit our liability for:

Our products

We attempt to be as accurate as possible in the description of the products displayed on the Website. Please contact our Customer Service Advisors if you would like more information about a product. The images of the products on the Website are for illustrative purposes only, and although we attempt to display colours accurately, we cannot guarantee that your computer’s display of the images accurately reflect the true colour of the products. The products sold are supplied for your domestic and private use only. You agree that you will not use the products for any commercial, business or resale purposes.

ORDERS & DELIVERIES

C’MOI orders are delivered Monday to Friday between 9am and 6pm. As every order is unique, shipping costs will vary depending on the size, weight and destination of your
chosen items.

Shipping Times:
– GLS 24: Spain mainland, Major Balearic Islands and Canary Islands in 24 hours./ Minor Islas Ceuta and Melilla 24/48 hours. Portugal: Lisbon and Porto in 24 hours. Portugal: peninsular rest in 36/48 hours. Azores and Madeira International Fare.

– GLS EUROBUSINESS: Only available within Europe: delivery within 2-5 days.

C’MOI will try to mediate between the customer and the delivery company in order to fix any problem that could arise. Please keep in mind that our shipping times should be used as a guide only and are based on time from dispatch. C’MOI can’t take responsibility for customs clearance delays or failed payment approval, though we will try to minimise any potential delays.

EXCHANGES, RETURNS & REFUNDS

We accept exchanges and refunds, just contact us by email hello@cmoi.site and we will arrange the exchange or refund according your wish. Very important! For a refund we need to receive the product in perfect conditions with its own packaging without being used, and after checking the product we will proceed with the refund if is in perfect conditions. If is not the right size, or you want to change colour or style; we will change without any problem. Please get in touch immediately, within 24 hours, by email hello@cmoi.site and we will arrange a new delivery with the new product. The deliveryman will take the wrong product with him when he deliveries the new one. Be aware that, if you do not hand in the wrong product he cannot deliver the new one.

PRODUCT RETURNS

If you need to return a product, we ask that you contact us immediately, within 24 hours, at the following e-mail address hello@cmoi.site, indicating the error or defect, along with your personal details, or either on our contact form. In the event of problems with the packaging, you must notify the courier service as soon as you receive the order.
We will examine the returned product carefully and notify you be e-mail within a reasonable period of time whether the item will be returned or replaced (if appropriate). The item will be returned or replaced as soon as possible and, in any case, within 30 days of the date on which we sent the e-mail confirming that the inadequate item would be returned or replaced. The amounts paid for products returned due to flaws, when they actually do exist, will be reimbursed in full, including any delivery charges paid to send the item to you and the costs to you to return it to us. The refund will be made using the same method as that of payment.
All rights recognised by the applicable legislation are reserved.

Returned items must comply with our returns policy:

– Items must be returned unworn, undamaged and unused, with all tags attached and the original packaging included.
– Footwear and accessories must be returned with the original boxes, silk paper and bags, where provided, and placed inside a protective outer packaging for shipping.
– When trying on footwear, please take care not to mark the soles or damage the shoe box.
– If an item has a C’MOI security tag or brand tag attached, it must be returned  with the tag in its original position.

Please take care when trying on your purchases and return them in the same condition you received them. Any returns that do not meet our policy will not be accepted.

If you processed your order through guest checkout please contact our friendly Customer Service to start your return.

Free Returns Pick Up: We are pleased to offer a free returns collection service to all customers for any purchases that meet our Returns Policy. Your returned item must arrive at the C’MOI headquarters no later than 15 days after your delivery date. We recommend that you book your return pick-up within 7 days of your delivery date to ensure that it arrives at the location within 15 days. Please note: We can only offer a free returns pick up from the same country your order was delivered to.

Notwithstanding the foregoing, if you have expressly selected a delivery method other than the least expensive, standard delivery, C’MOI will not refund the additional costs you have incurred in this respect.

If the recipient of the C’MOI products is not the person who paid for them, the funds will be refunded to the person who made the payment.

If you have placed an order for more than one article and do not wish to return all the articles in the order, we will only refund the amount for the articles you wish to return, without refunding all or part of the order delivery costs. The reason for this is that the costs incurred in a home delivery are fixed. They are paid for each order placed, and do not vary based on the number of items included in the order.
